1. INTRODUCTION

This website is published by Georg Jensen Pty Limited ABN 78 000 773 633, Unit 3 Allambie Grove,25 Frenchs Forest Road, NSW, Frenchs Forest 2086, Australia (Georg Jensen, we, our). By accessing this site, you accept these Website Terms and Conditions (Terms).

2. INTENDED GEOGRAPHIC SCOPE

This website and its contents are intended for access by persons located in New Zealand. We make no representation that the content and operation of this website will comply with any foreign law.

 

3. WEBSITE CUSTOMER ACCOUNTS

Customers may elect, as part of their registration for a customer account on our website, to include their billing details, which allows for a faster process when they place future orders. Those customers acknowledge they are responsible for the accuracy and completeness of any such information provided.

Georg Jensen stores personal information from our customers in strict compliance with our Privacy Policy and New Zealand laws, as set out in the “Privacy” section of these Terms below. 

 

4. PAYMENT METHODS

We accept Visa, Mastercard, American Express, JCB, PayPal, Google Pay and Apple Pay for purchases from our website via a secure online facility. If a payment method is declined at the time an order is placed on our website, that order will not be forwarded to us for further processing. Payment must be cleared prior to shipping of goods.

From time to time, some Goods may be out of stock or are unavailable and we may not be able to fulfil all or part of your Order. If this happens, we will refund you the price paid for the Goods impacted.

Please note that we do not store credit card details. Registered customers will be required to re-enter those details for each new transaction.

In some instances, we may require further verification information for a credit card to be used for payment. If so, our staff member will contact you. Examples of when this may occur include: multiple unsuccessful card charge attempts for an order, a delivery address that is unable to be verified, and orders that include high value items.

If we cannot reach you about your Order using the contact details you provided in the Order, after having made reasonable attempts to contact you, we will cancel your Order and refund any money paid.

Georg Jensen encrypts all of your card data with the so-called SSL (Secure Socket Layer) protocol. This means that unauthorized persons cannot read your card number or other information transmitted during the transaction with Adyen B.V. and PayPal, who handle payments for purchases made on georgjensen.com/en-au. Merchant of Record, i.e. the legal entity receiving payment for your purchase is Georg Jensen Pty Limited ABN 78 000 773 633, Unit 3 Allambie Grove,25 Frenchs Forest Road, NSW, Frenchs Forest 2086, Australia.

Title to goods passes upon full payment being received by Georg Jensen or the goods being dispatched, whichever is later.

PAYMENT WITH PAYPAL 

Georg Jensen offer payment with PayPal. PayPal has your details saved, so all it takes is an email address and password to safely complete your order. If you do not have a PayPal account, you can create one here.

 

5. SHIPPING

Georg Jensen offers shipping to New Zealand. The Freight is charged as international shipping and it is important  to be aware that your order may incur import duties on arrival from Australia to New Zealand. The actual price charged to New Zealand customers will be subject to the exchange rate applied by the credit or debit card company. Please note orders which are more than the equivalent of ~NZ$300 and shipped to New Zealand may incur GST, customs charges and duties charged by the NZ Customs Service once the parcel reaches its destination port and must be paid by the recipient directly to the NZ Customs Service or its authorised service provider. Additionally, your financial services provider may charge currency conversion and administration fees on purchases and any refunds we provide. We are not responsible for and will not reimburse any of these GST, charges, duties or fees. You can find more information here.

NEW ZEALAND CUSTOMS AND DUTIES

Georg Jensen offers shipping to New Zealand. Please note that in accordance with Australian export regulations we are required to declare the exact value of all items and identify orders shipped to New Zealand as dutiable “merchandise”. We are also prohibited by law from identifying an order as a “gift” for export purposes, even if a customer has placed the order with the intention of delivery to a gift recipient.

For more information on taxes, duties and customs regulations please contact your local customs office directly. Please note that by placing the order and accepting the Terms and Conditions you are agreeing to understand all information above.

UNATTENDED DELIVERIES

We strongly recommend that you do not instruct any shipping company to leave a delivery from us at any unattended location. Georg Jensen accepts no responsibility whatsoever for any delivery left at an unattended location.

ESTIMATED DELIVERY TIMES

 We will endeavour to deliver your purchase to you promptly, however, all shipments may be subject to delays  during peak periods or when shipped to regional areas. The following standard international delivery times to New Zealand:

• METRO AREAS: 2 – 10 business days.
• NON-METRO AREAS: 4 – 12 business days.

Please allow up to 5 extra days during sale periods. 

MULTIPLE SHIPMENTS

Orders will be sent in one shipment when all products in the order are available from stock. (If a product from your order is not available within our standard shipping times, a member of our staff will endeavour to contact you.) If you require multiple shipments of the items from a single order, please contact us as soon as possible after placing your order at store.online.au@georgjensen.com or 1800 441 765 so we can assist you. Customers who request multiple shipments from a single order will incur additional delivery charges.

STOCK AVAILABILITY

Please be aware that we receive online orders 24 hours a day. Therefore, an item you have selected may become sold out between updates of stock availability on the website and the time of your order.

If an item you have selected has sold out we will attempt to contact you at the email address and telephone numbers provided with your order to advise if and when stock will become available.

We will not be liable for a failure to deliver your order due to circumstances beyond our control, and if we cannot deliver, we will refund your payment.

TRACKING OF SHIPMENTS

Please note that we may supply you email address in addition to your contact details to our 3rd party freight companies only to allow you to track your order.

 

6. EXCHANGES AND STORE CREDITS

If you are unhappy about an item purchased from us, you may return it to us and we may, at our discretion, provide an exchange or store credit equal to the amount you paid for the returned item. Store credits must be redeemed within 12 months from date of original purchase and can only redeemed instore and not online.

You must notify us of your intent to return an item within 14 days of the purchase date of that item by contacting us at store.online.au@georgjensen.com or 1800 441 765. Upon receipt of such notice, we will provide you with a shipping address and return details. All goods must be received back by us in new and unused condition (including packaging) within 14 days of purchase for an exchange or credit to be issued. You will be responsible for any return shipping costs of undamaged or non-defective items. Items may also be returned to a Georg Jensen store (not including David Jones locations) for exchange or store credit if a copy of your purchase invoice is provided.  

7. CHANGE OF MIND REFUNDS & RESALE

Refunds for change of mind are not automatic and only available at our discretion.

Please note that rights to a repair, replacement, refund, cancellation or compensation do not apply to item that you plan to on-sell or change so that you can re-supply them as a business.

You must contact us within 14 days of the online purchase at store.online.au@georgjensen.com or 1800 441 765 to request a change of mind refund. Refunds for change of mind are only available at our discretion. for goods purchased via our online store, and those goods that we accept for a change of mind refund must be returned to the online store. Only goods that are returned to us in new and unused condition (including packaging) within 30 days of purchase are eligible for refund. If you have received a free gift as a part of your purchase, you must also return the free gift to us, if you no longer meet the conditions for receiving the free gift. We will deduct the value of any free gift, if you do not return it with the other items and no longer meet the conditions for receiving the free gift.  

You will be responsible for any shipping costs for goods returned to us for a change of mind refund.

 

8. FAULTY AND DAMAGED GOODS

While we make every attempt to ensure your goods arrive in undamaged condition, occasionally this does not happen. You must contact Georg Jensen at store.online.au@georgjensen.com or 1800 441 765 within 48 hours of receiving the goods to advise us that they are in damaged or faulty condition. We will then provide the postage details for the return of the faulty or damaged goods, which will be at no charge to you.

If there is a major problem with a product, you are entitled to either a full refund of the cost for faulty/damaged goods or a replacement of those items with identical new goods (subject to availability).

If you have a minor problem with a product or service, Georg Jensen can choose to give you a free repair instead of a replacement or refund.

Please note, stones may show natural discolouration or other natural variations that are not manufacturing or quality defects. Georg Jensen’s decision regarding minor problems is final.

If you choose to receive a refund, we will process that refund within 14 days of receiving the goods. However, you may not receive the refund for some time due to delays by the financial institutions. We have no control over such delays by those financial institutions.

If you elect to receive a replacement, those items will be sent to you as soon as practicable after we receive the returned goods. If we are out of stock of any replacement item, or that item has been discontinued, we will endeavour to contact you to discuss the matter.

If the item is discontinued, we may suggest alternate goods as a replacement. If you decide to accept an alternative item, you must pay any additional costs over the cost of the returned item, or if the cost of the alternative item is less than the returned item we will refund the difference to you.

 

9. PROMOTION AND SALE ITEMS

From time to time, we may offer certain goods as “promotion” or “sale” items (Promotion Items) with a discounted price. Often, Promotion Items contain minor flaws or damage.

You acknowledge that, by purchasing a Promotion Item, you accept that the Promotion Item is sold “as is” and that the discounted price of that item fairly reflects any flaws or damage it may contain. Therefore, Promotion Items are not eligible for refund or replacement, other than as required by law (such as in the case of an obvious manufacturing fault).

Purchases of Promotional Items is limited to 5 per item per purchaser, unless we indicate otherwise.

 

10. PRIVACY

Your privacy and the protection of your personal information is of great importance to us. Please refer to Georg Jensen’s Privacy Policy for information about how we use the data we receive about visitors to our website.

 

11. LINKED WEBSITES

Our website may contain hyperlinks to other websites (Linked Websites). Georg Jensen does not control the content of linked websites nor does it control the third parties operating those websites. We therefore accept no responsibility for the content, availability or operation of any Linked Website.

 

12. COOKIES

We use cookies on our website. A cookie is a small text file which is stored in your web browser and which registers you as a unique user. Read more about our use of cookies in our cookie policy.

 

13. ORDERS SUBJECT TO CONDITIONS SUBSEQUENT

The delivery of all orders received by Georg Jensen through our online store, notwithstanding our confirmation of any order and receipt of payment, are subject to the following conditions subsequent.

PRICING MISTAKES OR WEBSITE ERRORS

We endeavour to ensure that all information on our website, including the details, descriptions and prices of our products, is accurate. However, errors may occur from time to time.

We reserve the right to cancel an order (or part of it) prior to shipment where the website contained errors or inaccuracies, including, without limitation, out-of-date information and incorrect pricing, and misdescriptions or incorrect details regarding shipping, payment or return policies (all, Website Inaccuracies). Upon discovery of a Website Inaccuracy, we will contact you as soon as practicable to discuss a replacement order, If payment has been received, we will promptly refund the paid amount of the cancelled order (or part of that order, as applicable).

LIMITATION OF ITEMS

Georg Jensen may limit the number of items supplied per customer at our discretion. If an order exceeds that limit, we may reduce the number of items to the limit and will promptly refund any amounts paid for the items removed, and will notify you of that change as soon as practicable.

 

14. EXCLUSIONS OF LIABILITY AND DISCLAIMERS

EXCLUSION OG LIABILITY SUBJECT TO CONSUMER GUARANTEES

You have certain non-excludable rights under the Australian Consumer Law and the Consumer Guarantees Act 1993 (NZ) (both, Consumer Laws), including guarantees for the quality of our products and replacements or refunds if they are faulty or damaged when you receive them.

Subject to those non-excludable rights, Georg Jensen expressly disclaims any implied or express warranties or conditions of any kind as to the nature, standard, availability, fitness for a particular purpose, or otherwise relating to any product or service offered on this website.

EXCLUSION OF LIABILITY AND DISCLAIMER FOR USE OF THIS WEBSITE

Subject to non-excludable rights under the Consumer Laws, Georg Jensen, its representatives and associated agents are not liable for any loss whatsoever (direct, indirect, “consequential” or other) which may arise in connection with the use of this website or a Linked Website or from the use of the information, services, links or material contained on this website, or from an inability to use this website howsoever caused. ”Consequential” losses may include, but are not limited to, loss of revenue, loss of profit or anticipated profit, downtime, lost production, loss of reputation, loss of opportunity, loss of anticipated savings or wasted overheads and other losses, whether foreseeable or not. The materials and information provided on this website and related communications are provided "as is". Georg Jensen assumes no responsibility for, and makes no representations to you or any other person, as to the accuracy or completeness of the information on this website.

Georg Jensen cannot guarantee that our website will be bug-free or error-free, nor that it will not be down on occasions due to essential maintenance or technical difficulties. Georg Jensen therefore does not warrant that the website will be error-free or that it will be available at any given time or on any given day. While we endeavour to keep our website free from viruses and other malware, we strongly recommend that you use adequate protection against viruses and malware (e.g. virus scanners). You agree that the Content is protected by the laws relating to copyright, trademarks and intellectual property generally.

The Georg Jensen name, crown logo and all product names and/or product images on this website are trademarks (registered or unregistered) of Georg Jensen, its subsidiaries, affiliates, licensors or joint venture partners.

Except as expressly provided in these Terms, nothing set out in these Terms shall be construed as conferring on you any licence or right, by implication, estoppel or otherwise, under copyright or other intellectual property laws. You must obtain the prior written consent of Georg Jensen before you download, print, copy, reproduce or adapt (by electronic means or otherwise) any of the Content, except where allowed under Australian law, in which case Georg Jensen must be acknowledged as the source of the Content.

 

16. TERMINATION

Georg Jensen may terminate these Terms and your access to our website at any time without notice. In the event of termination you are no longer authorised to access the website, but all restrictions imposed on you and all disclaimers and limitations of liability set out in these Terms will survive.

 

17. GOVERNING LAW

These Terms are governed by the laws of New South Wales, Australia and you irrevocably and unconditionally submit to the non-exclusive jurisdiction of the courts of that State.
